Text messages can be recovered via subpoena. There was a case in Michigan about a year ago where a girl’s family sued the school claiming their daughter was raped during the school day on school property due to school negligence. By subpoena’ing the text messages the school board won the case. The girl had agreed via text message to meet the boy in the bathroom for the expressed purpose of having sex. The point of this story is, yes text messages are legally admissible. But please don’t represent yourself – it’s a bad choice. Hire a lawyer.
