Can I sue T-Mobile? Please Advise. ASAP!?




On 12/17/10, I made a payment of 4, for phone #1, which I have had since September 2010. On 12/20/2010 I opened a second line for phone #2 and paid for the phone and 8 for the first month service, total of 8. Two days later, I received the phone. On 12/26/2010, T-Mobile suspended service for both lines, claiming they have not received a payment for phone #2. I spoke to another T-Mobile rep being frustrated with the first one, to which they informed me of the same thing, no payment on file. Giving both reps the order #, they both were unable to locate it and stated there’s nothing that can be done. Angry, I asked for the supervisor, who also gave me the same line, to which I stated it is unacceptable, he then stated to conference the sales department to which he did. The sales rep with the order#, informed the supervisor, the payment was received, and I have FLEX-PAY so in order for me to have service and receive the phone, the payment had to of been received. The supervisor then credited my account, restored service and apologize, but claimed it was temporary, for as their investigating.
On 01/05/11 as I usually do was applying for employment, I applied to at least 30/40 jobs and I was called in for an interview the following day. Having that interview I was told to wait on their call, for the next steps as a fellow friend worked there. That day came, I hadn’t received any call, no call or text from anyone to be exact, trying to call out, I realized once again service suspended. I began crying and became irate. I called T-Mobile, and angry asked why is my phone suspended. The rep stated the payment for phone#2. Was returned, declined I need to make a payment of 9 to restore service for phone#2 immediately, and since phone#2 is suspended, phone#1, even though it was paid for previously will be suspended too. Aggravated, I hung up and called my credit card company and conferenced the call with another T-Mobile rep, my payment was received, the credit company approved it, the payment was never declined. The T-Mobile rep told both the credit card company and I, that even though their verifying it, there’s nothing that can be done until proof is provided.
My rep stated my statement closes that day so I will receive it in 5-7 days, and T-Mobile stated after it is faxed to them it can take up to 5 days to process, so in all I will be left with no phone for 15 days, for service I paid for. I asked them is there anything I can do to resolve it quicker, I need my phone, it is unfair, to which I was transferred to financial, to which that rep then asked me for a payment, angry I explained everything to him, and he as well stated there’s nothing he can do, either I make another payment or fax the proof of payment, so I hung up, realizing they aren’t going to help me. Until I fax my statement, which I will once I receive it. I have also asked them to disconnect service on 01/16/11 when my cycle ends, as I no longer want to keep a cell phone and am just disturbed with people in general.
I am in a bad place, my phones are my life, and T-Mobile has taken that away from me. I have no form of contact with the outside world, I’m annoyed, stressed out, emotional and I just wish this didn’t have to happen. All perspective employers will not contact me through E-Mail, so I’ve lost potential interviews. I don’t mean to be bitter but it’s taking a toll on me emotionally, this is unfair. Please read, understand, comment and advise




Came home today to find my internet and phone disconnected. We have had no warning whatsoever. We had changed our payment details and got a message on the 15th saying that the payment was in place and all neccessary funds would be taken from there. All I could get from the phone was Talk Talk who told us it could take up to 48 hours to put back up. All for a problem that is theirs.
I rely on the internet for business, homework etc and it is simply neccessary. Furthermore, what if I was an old person or pregnant lady who relied on the phone? Disgusting in this day and age an I was told by their supervisor that there is no warning system in place. Discrase.

Question is, is what they have done legal and if not, which law are they breaking?
I’m in the UK, paid the bill as the money has been taken. Quick enough to turn it off but takes 48 hours to put back up again? I also notice they do not have systems in place to warn people about this but do have the systems to send me spam to try and get me to buy more of their rubbish.




Im doing a project on EEG machines and this is our assignment. "Imagine you are a Bio med working for a hospital at an in-house shop. A call comes in for the Sleep Lab. Apparently, the EEg scanning software locks up on the computer when it starts. Everything else on the computer system runs correctly, There is a patient on the bed and the supervisor wants someone to look at the machine immediately. What is the best course of action to troubleshoot and repair this computer system with respect to cost/downtime, customer service, and without losing patient data?




I work in advertising and our floor is an "open atmosphere" that has been promoted as an environment that increases communication. However, since a recent merger that has changed the makeup of those within the office, the open environment seems to be cultivating an environment social interaction.

I am a supervisor and my seat within this environment is next to another supervisor on this floor. This supervisor has a bit of a different work ethic than I and places more emphasis on being the social butterfly of the group as opposed to a professional leader whom is respected by his coworkers for his knowledge of the business.

Often throughout the day, this coworker will spend up to 30 mins talking away on his cell phone to his friends overseas or carrying on with conversations with other coworkers. Over the past 5 months, I have complained to our management that I do not like sitting in this environment (specifically next to this social supervisor) and asked to be moved to an environment that is more like the environment I had agreed to work in prior to the merger. Recently after asking my management to discuss this issue, it was suggested that while waiting for a response, I simply check out a laptop from IT and work in a quieter area of the office. When the head of my group heard that I had done just this, I was told "that it was unacceptable and to return to my assigned seat".

This flagrant act of alternative dispute resolution lead me to contact HR. HR took the situation seriously, but stated that HR was not aware of any other complaints (despite the fact that there are a few others that have expressed a disappointment in the change of environment). Not really having an argument to dispute the fact that HR had no other complaints, I questioned the tone and the approach that management had taken up to this time, as an example that the lack of professionalism is in fact missing from our group and accepted.

To make a long story short – I am considering just resigning my position as I clearly see no future now that the merger has taken place. However, the group my group sits on 2 separate floors, the second of which I have experienced as being perfectly tolerable. I DO see a future by simply sitting on this quieter floor.

Am I really at the mercy of a terrible work environment such as this? Am I really at the mercy of management that does not wish to work with their employees and ensure that serious and (not to brag) but competent employees are happy with their work environment?

I hate to be one to "abuse" the system but are changes in environment due to a merger, grounds for a compensated resignation? By the state?

Any suggestions would be helpful. Thank you!

Who is "Someone else"?




I’m a non-native English speaker from outside of US, not well educated. Excuse me for my reckless English writing.

Everytime I get laid off, supervisors say "You are still young and have good talent. Someone else’s going to give you better job".

15 years ago, I was hired by a small construction company as a contruct worker for 5 years.
My job was simple, such as driling and carrying materials.
Along with the company’s bussiness grew bigger, they hired more workers and bought large construction machines (Driling & carrying much faster than human).
But few years after, their business was fading and they started laying off many workers including me.
They still had as many jobs as they did 5 years ago, but they have large construction machine and no longer needed as many workers as 5 years ago.
The supervisor described me that as what they call "restructuring".
Then he said "You are still young and have good talent. Someone else’s going to give you better job".

So, I checked classified ad on news papers to find a new job.
I found new job as a welder at a large auto-maker’s plant.
I worked as a welder for 4 years, but they bought what they call "weldering robot" (Weldering much faster than human).
So, they relocated me and others to assembly line. Of course they’ve cut the pay of us.
After a year, they bought automated assembling machine and called for voluntary retirement.
The supervisor said "You are still young and have good talent. Someone else’s going to give you better job".

Fortunately, I have commercial vehicle license and found a job as a short distance truck driver between parts making plant and assembling plant of auto-maker.
I worked as a driver for 5 years. But what they call "financial crisis" occurred and the auto-maker I work for also must close some of their plants.
Since they have to do what they call "cost cutting & restructuring", they are planning to build parts plant near the assembly plant and use automated transfer system between them.

Now, I’m ready to hear "You are still young and have good talent. Someone else’s going to give you better job" again.

Who is going to be next "Someone else" for me? Machines?

I used to buy products from whom I work for, but without job, I can not afford products they make any more…..and I don’t think I can keep paying for internet fee until I get answear….

I also used many "Someone else" myself.

I’m recently sending new year’s day cards to my friends with using my mobile phone.
"Someone else is sending their cards by post, so post-man will not loose their job"…..

I read news on the internet, so I don’t subscribe any news paper or magazine.
"Someone else subscribe news papers and magazines, so news paper company will not run out of their business."

I’m going to lose my job soon and cut my expenses.
"Someone else is going to spend money and create new job"…..

NOOOOOOOOOOO!!
I’ll be the one who create my own job this time!!
And never be the one who says "Someone else".




Contract is a wireless internet hotspot service available at certain places. The problem with blaming it on technical issues such as hardware or software is that they will make me troubleshoot with them by taking me by the hand and painstakingly going through all steps to correct the issue. I’m looking more for a situational issue I can make up to stir up empathy with the customer service people or their supervisor to terminate the service as hassle free as posible.

Any creative ideas?

I have a hearing in the near future with my former employer. They have requested a telephone hearing for my supervisor because she has relocated to Washington D.C. (The hearing is in California). Can I object to my supervisor being allowed to testify by telephone because it states that "ordinary press of business" is not a valid excuse for a telephone witness.




I am a third year college student about to begin the course work that will prepare me for my Telecomm degree. I would LOVE to work in the media industry somehow…whether it be music, film, broadcast, publishing, etc… However, I have been told by at least 3 people now that a Telecomm degree won’t get me anything but a job in Telemarketing. This is very discouraging to hear. I don’t mind a challenge, but I don’t want to continue with this program if there’s no hope of working in the entertainment/media industry. I have NO desire to work in telemarketing, not even as a manager or supervisor. Thanks for any input :)




I’m a teller at a bank and I just got my BA in business management. And I just don’t know what to do for here, I feel like I’m lost and nowhere to turn. I need help please someone, can someone give me some tips or even where to being. Most of my experience is in customer service, 6 months supervisor, and 6 months in HR. I have been working since I was 17 and i’m 24 now.




For 3 months, I worked at a business where things seemed off. From day 1, I started questioning the legalities of some of their actions. Sadly, I don’t know if some of the questionable things or just something I am not familiar with. Either way, it’s shady. So if anyone knows what of these odd things may be illegal, can you please tell me?
On day 1, I filled out the paperwork and on the last page of this paperwork, was this page that said "sign here, to confirm that you have read and understand the company handbook." The manager took the paperwork and said why didn’t you sign this page? I said b/c I was never given a handbook to review. She said "oh ya, I don’t think we even have a handbook." No biggie to me. Every other job I have had, did the handbook stuff on day 1.
Then when I get put in my room to start actually working (after the paperwork), I was told about our quota and trained on the job and it was easy. About a week later, we had an orientation for the newbies (maybe 6 people) in the room. The HR department told us that "we have no daily quota. It use to be that they did, but now they go by a weekly quota instead." After the orientation, I went back to my desk and my supervisor and her manager said that’s not right. You get penalized if you don’t work to get 10 vendors every day. If you don’t get them, you must stay after. Or you can just get written up. If you do stay after work, it is overtime. However, the company takes the overtime pay out of the allotment for bonuses that they give us at the end of the week. So when we get our checks, it shows our hours, our bonus amount (if any) and the overtime we worked, which is subtracted from the bonus we earned.
Also we are told that we get an hour lunch, which we don’t clock in or out for AT ALL. Some days if it is really busy, they have us only take a half our lunch. They don’t pay us for the half hour that we work during those lunches. If any of us ask to get paid for that half hour, it’s a huge debate and they usually just tell us that "we will get paid for it, because we sometimes get bonuses and overtime comes out of bonuses anyways, so it works out the same." "we shouldn’t worry about if that half hour of pay shows on our check as overtime or our bonus, as long as we get it.
Also, there were a few times when our manager would tell us something and then a few minutes later they would tell us something different. They want us to be sure to enter our stuff in an extra system as well as make time in our day to send out mailers to our clients. This is required work and they tell us that we need to do it, but they DO not allow us to do it at work. if I am of fthe phone even for a few minutes, I get told to get back on the phone. So as a result, I stay after or work during my lunch alot to try to make up for these things that they expect but don’t give us time for.
However, if we stay after, they frown on that.
Also, I asked the HR manager if I could have a copy of the employee handbook and have our bonus structure in writing. I also asked if I could have a list of company policies in wriitng just to avoid inconsistencies that happen with managment and their constantly changing rules. He refused and said that there is no Washington state law saying that I should get anything in writing. Our supervisor passed out our bonus structure and told us to hang it by desk and then a few minutes later she came and pulled it off of our desks and said that they don’t want us to have written access to our bonus structures.
Then, when I am calling different restaurants and businesses like I am told to do, I need to do whatever I can to get them to agree and be on the card that they make. If the owner or manager at that business says no. Then we need to ask a few times more in that conversation and even lie to them. My supervisor and manager told me to lie many times to get them to agree to be on the card. I can tell them stuff like they were requested by name and I can send them a copy of the card. Sometimes if they say no enough, I have to call them back again later and even my supervisor will call them again and try to get them on the card. What we offer is free and beneficial to them, but some people just don’t want to be on. Sometimes we ahve to call these places so many times that they threaten to call the cops on us as we are harassing them. If my client doesn’t answer the p hone, I am told to keep calling them over and over and block my number. I am told to stalk them basically and then punished if that person calls in later to complain about me calling too much.
Also, there are often times when management and supervisors will argue really loud in the office and the hallway. They argue loud enough for us to hear their disagreements, which is very unprofessional.

I work for a family-owned company. One of the owners continuously gets calls from "Online Pharmacy." He, as well as several office personnel, have asked him not to call anymore. He continues to call back. This has gone on for months. He will call right back if we hang up or put him on hold. He has gotten rude with several of my employees, as well as overstepping the line by telling me (thinking I was the owner), "You need to buy. Your wife is beautiful….." and "I’m just wanting to build friendship." When I asked him what his phone number and address is, he said, "What? No address." He uses several names such as Joe, Mike, and John. We even asked for his supervisor one time and when we said something about talking to Mike (as the caller had identified himself as such), the supervisor didn’t know who we were talking about. The Do Not Call Registry is for individuals. Can I register a business phone since he is calling for an indiv? Owner uses this address/phone for his crd card billing
Any other advice would be appreciated.

Was I just scammed?




I just got a phone call at work that sounded like it was from overseas. The caller was "confirming" our company’s "free yellow pages business listing." He already knew our company name and contact info and I said "correct" as he read it back.

Then the call got weird. He got me to spell out my name and then asked for my job title. When I answered, he said that title wasn’t in their system and I should just say I was a "supervisor" when he transfered me to someone who was going to confirm our listing.

A second guy came on and said his call was being timed, so to please not interrupt him because he had to complete it in so many seconds. Then he said to interrupt him if the info was wrong. He repeated this mumbo-jumbo several times.

When this caller asked me my job title, I gave my original answer. He said, "A supervisor?" When I answered, "Not really," he hung up.

Has this happened to anyone else? I’m afraid I said "yes" at one point and they’ll be able to scam me.
They already knew our company information, so the only thing I really gave them was my own name.

I’m not sure what it means that they hung up on me.




I’ve been working with a man who I have never met, he is in LA and I am a few hours north of him. He has been extremely helpful in helping me with my prior requests, but unfortunately, he will no longer be able to help me.

I wrote my request, then he wrote back:

"Ms Baron
Our Systems Division will be handling all future requests for data. I’m not sure we have the file back from the newspaper. I’ll forward your e-mail to them as soon as I ascertain who is taking care of these requests. I think there might be a charge for the file to cover the cost of producing it for you.
Hope all is well."

So heres a few more facts…i’ve only done about 6 email transactions with him, he works with the county, and it took WEEKS for me to find a ‘live’ person who could finally help me figure out exactly what I wanted. He’s like ..the supervisor’s supervisor. I dont want to get lost again in the shuffle…and often a transfer is put on a pile of a desk to sit for weeks/etc…or lost in old email files…

Summer 2008 I worked for Lifetouch Prestige Portraits through a temp agency called StaffMark. November 4th, 2008, I was called into the office and was told that my supervisor didn’t think my shirt was appropriate. I was wearing a green tank top with a green cap sleeve blouse over it and was covered by a blanket as it was a call center that tends to be ridiculously cold. The three StaffMark employees that were in the office all claimed that my attire was nice and very professional, but since a complaint had been made, I had to go home and change.
I advised the women that if I had to leave, I would probably be unable to return until the next business day. I had never missed any work before and was told I would get points marked on my employment sheet, but it was fine if I couldn’t return until the next day. I got a call from the office at closing time, about 5 p.m., saying that, due to my refusal to return to work, I was being terminated and I could pick up my things the next business day, if possible.
I returned to the building the next day to pick up my things and asked why I was fired. They told me they had decided to terminate me for my refusal to return to work (even though it was the only day I had missed and you can miss up to four or five days before getting so many marks that you are eligible for termination). I explained to them that I did not have regular access to a vehicle and it took me three hours to just GET HOME that day and I pointed out that I had told them I would return the next business day on time as usual if I was unable to return that day. They then tried to point out other reasons for firing me, all of which were absolutely untrue, then turned around and apologized for firing me for no reason and offered me a position through their temp agency at another company right there and then.

I was employed two weeks later, through my own efforts, full-time through a company as I no longer trust temp agencies. I didn’t like the company I was working for, so I continued to look for work elsewhere. I was contacted by a company I applied for and was told that they had contacted StaffMark, who was the company they were hiring through, and was told I was not eligible to work through them because I walked out on the previous position I had through them.
This is obviously a lie and I told them what had happened and they agreed that it was wrong for them to lie like that, but since that’s who they were hiring through, I was not eligible to work at the company.
November of this year I was terminated from the job I did have. I filed unemployment and was granted it, but when I refiled it automatically selected StaffMark and of course, they contested it, but their explanation wasn’t that I hadn’t worked for them for over a year, it was that I had voluntarily left my job.
I just got off the phone with them and asked them to change this false information and the woman I spoke with was very rude and said that what they have in the system, false or not, cannot be changed and it is what they have on file and will give as reason my employment ended, yet also said they only give dates worked, not reasons employment stopped. This is obviously false and I spoke with the woman for quite a while and she eventually said she would no longer speak with me on this matter. When I told her I could bring up legal action against her, she started yelling and screaming, telling me that was impossible.

This is obviously fraud, slander, and defamation of character, correct? Would it be possible to have them legally change their false information or pay me reparations for job opportunities missed because of their lies?




My work-issued cell phone was canceled. I told my supervisor that I didn’t think it was fair that I should have to take work-related phone calls on my personal cell phone.

Can I be fired for not taking work-related calls on my personal phone?
